Victim-Harpal Singh was killed by Raghbir Singh and his police party on the 18.09.1992 in fake encounter. Harpal was picked up from his house on 14.09.92 AT 5:00 AM by SI Ram lubaya and was taken to Police Station Beas. Harpal was kept for 4 days in Police station Beas and then was shown to be killed in a fake encounter on the intervening night of 17/18.09.92 at village Nijjar. Harpal was just 15 years old when he abducted and brutally murdered by the police officers.

The police claimed that 2 boys was coming from the front when they were patrolling along with CRPF at village Nijjar and on seeing the police party the 2 boys started firing on the police party and the firing took place for 20 minutes in which the police fired 217 cartridges and after the firing stopped in the search operation it was found one boy whose name was Harpal Singh was killed. No used cartridge among 217 was collected by the police party and deposited in the Malkhana, no ammunition records were deposited in the Malkhana, non of the police officers in the said encounter sustained any injury not there vehicles at the spot were damaged.

Court

Police concocted false story of the fake encounter and killed Harpal Singh. It was also alleged by the police that the other boy Harjeet Singh who was said to be escaped from the spot of encounter had confessed his presence at the time of fake encounter was also then killed after 15-16 days by the Punjab Police. Harpal singh’s body was also not handed over to his family and was illegally cremated as unidentified and unclaimed. Post mortem report held Harpal was shot under his right eye and one on his forehead from a distance of 3 metres.

Today after 26 years waiting for justice the court of Sh. N.S Gill, CBI Judge, Mohali finally convicted Raghubir Singh, the then SHO Beas and S.I Dara Singh, under section 302, IPC and sentenced to life imprisonment. Three other accused police officers are acquitted. Ram Lubaya, the main accused died during the trial and was facing other similar cases of fake encounters. Public prosecutor for the CBI was Gurwinder Singh Counsel and team for the Complainant (Balwinder Kaur, widowed mother of Harpal Singh) was Satnam Singh Bains, Rajwinder Singh Bains, Sarbjit SIngh, Jagjit Singh,Bar Pushpinder Singh, Harjot Singh, Baljinder Singh, Barjinder Singh Sodhi.
