Mittal and Justice Avneesh Jhingan issued notice to the chief secretary Government of Haryana, Principal Secretary,  Department of Medical Education & Research, Haryana and to the private medical institutions situated in State of Haryana in a Public Interest Litigation filed by Dr. Sandeep Kumar Gupta through Counsel Sardavinder Goyal with following prayer:-

For quashing of the notification dated 15.06.2018 (Annexure P-1) passed by respondent No. 1/2 whereby fee structure for admissions to MBBS/BDS courses in private medical colleges situated in State of Haryana has been fixed which is exorbitant, illegal, arbitrary and unconstitutional as there is no difference of  fee structure in 50% state quota seats and in 50% management quota seats, furthermore the fee structure is not in accordance with the law laid down by the Hon`ble Apex court in Islamic Academy of Education and others Vs State of Karnataka, reported as (2003) 6 SCC 697 whereas the fee structure fixed by the neighboring State (Punjab) vide notification dated 06.02.2018 (Annexure P-2) is much lower than that fixed by the State of Haryana.

Further payer is for issuance of writ in the nature of mandamus or any appropriate order directing respondents in the interest of public at large to ensure that the fee structure at various private medical and dental colleges situated in the State of Haryana is fixed as per directions of the Hon`ble apex court in Islamic Academy of Education and others Vs State of Karnataka, reported as (2003) 6 SCC 697 and that a reasonable fee structure be fixed for seats in medical and dental colleges keeping in view the fee structure notified by neighboring state i.e. Punjab.

Further respectfully prayed that official respondents may kindly be directed to recover the excessive fee charged by the private colleges from students who secured admission in MBBS/BDS courses in private colleges and use this money for granting compensation to the meritorious students who could not get admission due to exorbitant fee structure and also to use this money to create a corpus fund in order to sponsor education of deserving poor students.
