NEW-DELHI: India, the world's most populous democracy, grapples with a critical societal issue as the legal standing of same-sex marriage remains unrecognized in the country. Millions of LGBTQ couples face legal barriers, impacting essential matters such as child adoption, insurance, and inheritance. Currently, Indian law designates only one parent as the legal guardian of a child in LGBTQ partnerships, underscoring the urgency for change. An influential hearing on this matter is set to transpire today.

India stands as a beacon of democracy; however, its stance on same-sex marriage diverges from the ethos of equality and acceptance. In a pivotal legal battle, India's Supreme Court has been actively engaged in hearing arguments presented by activists challenging the existing law since April. This landmark case has captivated the nation, with the proceedings broadcasted live for public viewing. Advocates representing the 18 petitioners argue that it is imperative for India to recognize LGBTQ individuals as equal citizens within the constitutional framework.

However, advocates for LGBTQ rights face a formidable adversary in the ruling Bharatiya Janata Party (BJP). The government contends that same-sex marriage is a "Western" concept devoid of constitutional support. Recently, the BJP expressed the view that such unions are perceived as "urban" and "elitist," and thus, unwelcome in the country.
