X from Elon Musk Blasts Indian Government for Apparently Imposing Censorship Tool latest news: Elon Musk's social media platform, X (formerly Twitter), has moved a petition before the Karnataka High Court, charging the Indian government with having an "unlawful and unregulated" censorship system.
The platform alleges that the government is abusing Section 79(3)(b) of the Information Technology (IT) Act and the Sahyog Portal to circumvent the procedural safeguards under Section 69A, which the Supreme Court has validated as the only valid set of provisions for blocking online content.
X contends that the government action bypasses judicial requirements like the issuance of written reasons, pre-decision hearings, and grounds for legal appeals. The corporation has also disparaged the Sahyog Portal, an internet system launched by the Ministry of Home Affairs, for facilitating takedown requests without transparency or control. X charges that the portal establishes a shadow censorship regime that empowers thousands of officials to issue takedown orders at random.
The platform has moved the courts to strike down all takedown orders made under Section 79(3)(b) and to limit the enforcement of orders from the Sahyog Portal until a final order is made. In a preliminary hearing, the government assured that no punitive action had been initiated against X for failing to join the Sahyog Portal. The court has permitted X to approach the court if any preemptive action is initiated against the platform.
This was not the first legal battle for X against the Indian government. The platform had also contested takedown orders issued under Section 69A in 2022, alleging free speech violations and a lack of transparency.
Adding to the furore, the Indian government has also expressed concerns about X's AI chatbot, Grok, which was criticized for giving uncensored and abusive answers. The government has asked X to explain the training data and moderation process employed for Grok, as well as the chatbot's objectionable outputs.
The next date of hearing in the case is set for March 27, a crucial milestone in the ongoing debate on digital rule and free speech in India.
