Delhi High Court overturned the lower court's decision

NEW-DELHI: In a recent development, Raghav Chadha, a member of Rajya Sabha from the Aam Aadmi Party (AAP), received a favorable ruling from the Delhi High Court, averting the need to vacate his current Type-7 government bungalow. The High Court ruled against the lower court's decision to lift the interim stay on proceedings initiated by the Rajya Sabha Secretariat.

Justice Anup Jairam Bhambani presided over the case, confirming that the stay order issued by the lower court pertaining to the Rajya Sabha Secretariat remains in effect. This stay will persist until the trial court makes a determination regarding the application for interim relief.

During the recent proceedings, the Delhi High Court reserved its judgment regarding Raghav Chadha's petition, which contested the trial court's decision to nullify the interim order preventing his eviction from the allocated government bungalow. After the completion of the proceedings, Justice Bhambani informed the Rajya Sabha Secretariat's counsel that no further actions should be taken until the High Court delivers its final verdict.

It's essential to note that, as outlined in the 'Handbook' issued for Rajya Sabha Members in April 2022, Raghav Chadha, as a first-time Member of Parliament, is eligible for a standard 'Type-5' bungalow. According to this handbook, individuals such as former Union Ministers, Members of Parliament, former Governors or Chief Ministers, and former Lok Sabha Speakers possess the right to reside in 'Type-7' bungalows.
