The court also urged the Delhi government to consider implementing a permanent ban on firecrackers by November 25.

Supreme Court on Air Pollution in Delhi: In a stern rebuke to Delhi Police, the Supreme Court today labeled the existing firecracker ban in Delhi as an "eye wash," asserting that a comprehensive, year-round prohibition is necessary, not just during Diwali.

A bench comprising Justices Abhay S. Oka and Augustine George Masih emphasized that no religion promotes pollution-inducing activities, highlighting that unrestricted firecracker usage infringes upon citizens' fundamental right to health. The court directed Delhi Police to ensure strict enforcement of the ban, mandating that the Police Commissioner inform all stakeholders about the Supreme Court’s decision, and prevent licensed sellers from manufacturing or distributing firecrackers.

The court also urged the Delhi government to consider implementing a permanent ban on firecrackers by November 25, citing the severe health risks posed by the toxic smog that blankets the capital each year. This directive follows the court's recent admonishment of both the Delhi government and police for failing to adequately enforce the firecracker ban, which is reissued annually before Diwali with minimal impact.

A Call for Immediate Action on Firecracker Ban

During Monday's hearing, the Supreme Court expressed frustration over the recurring ineffectiveness of the ban, demanding an "immediate" response from both the Delhi government, led by the Aam Aadmi Party, and the Delhi Police, which falls under the Union Home Ministry. The court pointed out widespread reports of non-compliance with the ban this year, calling on authorities to clarify the steps they had taken to enforce it and to outline future measures for a "complete ban" on firecrackers.

“This ban is intended as a crucial measure to reduce pollution," the bench emphasized, reiterating the urgent need for action amid Delhi's annual air quality crisis.
