The Foundation has urged the court to ensure that online content regulation includes safeguards for disabled individuals.

Comedian and YouTuber Samay Raina is facing additional scrutiny as the Supreme Court of India expressed concern over allegations that some of his videos mock persons with disabilities.

An application filed by the Cure SMA Foundation alleged that Raina made insensitive jokes about Spinal Muscular Atrophy (SMA) patients and individuals with visual impairments. The Foundation has urged the court to ensure that online content regulation includes safeguards for disabled individuals.

The Supreme Court, currently hearing petitions regarding content moderation from digital creators like Ranveer Allahbadia and Ashish Chanchlani, took note of the allegations. Justice Surya Kant, calling the matter “disturbing,” directed the applicant to submit video evidence and initiate the process of adding Raina as a respondent.

The flagged content reportedly includes a joke about a two-month-old SMA patient who needed a life-saving injection worth ₹16 crore—a case that previously came before the court. The Foundation argues this is part of a broader trend of ridiculing persons with disabilities online.

The court has not yet issued a ruling against Raina but indicated that the allegations are serious and could warrant independent legal action.
