As per Article 101(4) of the Constitution, a member's seat could be declared vacant if he/she is absent for more than 60 days without leave. Amritpal Singh, who is already under detention under the National Security Act (NSA) in Assam's Dibrugarh district, has already been away for 46 days. With only 12 days left before his seat can be declared vacant, his lawyer brought out the seriousness of the issue, emphasizing that Singh must represent his 19 lakh voters in Parliament.
Singh had also earlier filed a petition on January 23 seeking permission to be present at the Parliament session and join the Republic Day celebrations. Singh contended that his detention was politically driven, meant to suppress his rising popularity. Singh, who got elected to the 2024 Lok Sabha election from Punjab's Khadoor Sahib constituency as an independent candidate, has been a persistent voice for his constituency and has been detained on several occasions after returning to Punjab in 2022.
The court has requested clarification from the Union of India regarding whether Parliament has established a committee to deal with these issues as yet. The case has been adjourned until February 25. The case of Singh highlights the balance between security requirements and the constitutional rights of democratically elected members, and also the effect on democratic representation caused by extended detention.
While Singh waits for the court to pronounce its verdict, Punjab's political atmosphere is charged. His supporters continue to protest against his detention and the implications it would have for his constituency.
