Union Home Ministry Authorises LGs of 5 UTs to Act Under Drugs and Magic Remedies Act
The Union Home Ministry has delegated significant powers to the Lieutenant Governors and Administrators of five Union Territories, including Chandigarh and Jammu & Kashmir, to take strict action against misleading medical advertisements.
The report suggests that these officials can now authorise gazetted officers to search premises and seize records related to "magic remedies" that claim to cure chronic diseases like cancer and diabetes.
The notification was issued in the central gazette. It covers the Union Territories of Chandigarh, Jammu & Kashmir, Puducherry, Lakshadweep, Dadra and Nagar Haveli and Daman and Diu.
Under the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, these administrators will now exercise the powers of a state government within their respective territories.
This law prohibits the advertisement of drugs for 54 specific diseases and disorders, prohibiting companies from marketing products as "magical cures" for conditions such as obesity, heart disease, and diabetes.
Authorised officers will have the mandate to initiate action against cases of default, including the seizure of records from print and electronic media.
The move is focused on protecting citizens from health fraud and exaggerated claims, particularly concerning Ayush medicines.
This delegation of power ensures that local UT administrations can act swiftly to prevent the exploitation of patients through improper or misleading medical promotions.
