Is President's Rule on the horizon for Delhi? This question arose after President Droupadi Murmu forwarded an appeal by the Delhi BJP to the Ministry of Home Affairs, demanding the dismissal of the Delhi government. Leader of Opposition in the Delhi Assembly, Vijender Gupta, has confirmed that the memorandum submitted by BJP MLAs, accusing the Aam Aadmi Party (AAP) government of violating the Constitution, has been sent to the ministry for further action.
Vijender Gupta claimed in a statement that the Delhi government’s failure to constitute the sixth Delhi Finance Commission and its inaction on the Comptroller and Auditor General (CAG) reports represent significant constitutional violations.
On August 30, a delegation of BJP MLAs met with President Murmu, urging her to intervene in what they described as a "constitutional crisis" in Delhi, primarily due to Chief Minister Arvind Kejriwal’s imprisonment. Sharing a letter from the President’s Secretariat, Vijender Gupta stated, “The President has taken cognizance of the memorandum and forwarded it to the Home Secretary for further action.”
The BJP MLAs, led by Vijender Gupta, expressed serious concerns over the governance in Delhi under CM Kejriwal. They urged the President to intervene, stating that Kejriwal’s continued stay in jail for over four months, due to his alleged involvement in the excise policy scam, has paralyzed the administrative system in the capital. Despite being in jail, Kejriwal has refused to resign, causing a "complete collapse" of governance in Delhi, according to the memorandum. The BJP claimed that essential services and important administrative decisions are being delayed, adversely affecting the citizens of Delhi.
The memorandum highlighted constitutional violations, such as the failure to establish the sixth Delhi Finance Commission since April 2021, which contravenes Articles 243-I and 243-Y of the Indian Constitution. This delay has reportedly disrupted financial planning and resource allocation for Delhi, particularly impacting the Municipal Corporation of Delhi (MCD).
Additionally, the BJP accused the Delhi government of failing to table 11 CAG reports in the Legislative Assembly, undermining transparency and proper scrutiny of the government’s financial activities. This lack of oversight, the memorandum claimed, raises questions about the financial integrity of the AAP government.
The memorandum also pointed to several allegations of corruption and financial irregularities within the AAP government, including the Delhi liquor scam, which led to the arrest of key government ministers, and irregularities in the Delhi Jal Board’s finances, with no balance sheet prepared for 2021-22 and 2022-23.

MLAs Mohan Singh Bisht, Om Prakash Sharma, Ajay Mahawar, Abhay Verma, Anil Vajpayee, Jitendra Mahajan, Kartar Singh Tanwar, and former Delhi Minister Rajkumar Anand joined Vijender Gupta in appealing to President Murmu for the invocation of Article 356 of the Constitution to dismiss the AAP government. They argued that governance in Delhi has deteriorated to the point where immediate presidential intervention is necessary to safeguard constitutional values and democratic norms in the national capital.
