SC's Order is a great tribute to Parkash Singh Badal: Daljit Singh Cheema

Supreme Court

New Delhi: The Supreme Court has granted major relief to the Shiromani Akali Dal and dismissed the summoning order in the dual constitution case. Before this, A criminal case was filed against the senior leader Balwant Singh Khera, Former Chief Minister Parkash Singh Badal, Former Deputy CM and SAD Chief Sukhbir Singh Badal, Daljit Singh Cheema in a Hoshiarpur court. The accusation was that the Akali Dal had made two constitutions in which one constitution was given to the Election Commission of India and a separate constitution was made for contesting the SGPC elections.

In this case, the civil judge of Hoshiarpur, Monika Sharma, had summoned late Parkash Singh Badal, Sukhbir Singh Badal and Daljit Singh Cheema to the court, on which the Akali Dal challenged directly in the High Court under Section 482 of the CPRC, instead of filing a review against these summoning orders in the court of the session court. The High Court dismissed the appeal of the Akali Dal after which they approached the Supreme Court.

On Friday, Justice MR Shah and Justice JB Pardiwala of the Supreme Court dismissed the summoning orders of the lower court. The Supreme Court said that there is no reason for these summoning orders and  just because someone is religious it can never be said that he is not secular and a religious person can also be secular.
