HC directs the DEO (Secondary), Bathinda to produce Footage of CCTVs installed at Gate of examination Hall of St Xavier School, Bathinda

Chandigarh-March 20th- While issuing notices to CBSE (Central Board of Secondary Education) for 25.3.2019, in a Writ Petition filed by Deepanshu Bansal of Mansa, who alleged that he had reached at the gate of the examination Hall of St Xavier Senior Secondary School, Phase-3, Modal Town, Bathinda, on 2.3.2019, for appearing in English Paper of 12th Class, at 10.03 AM, but he was not allowed to enter the Examination Hall by the Principal-cum-Centre Supdt of the said School,

which is affiliated with CBSE, resulting into loss of full one year of his educational career, as he is to seek admission into MBBS Course, on the basis of NEET Result. However, even if he appears in Compartment examination this year, for passing paper of English, he would be late, as counseling will by then be over. Castigating the conduct of the Centre-Supdt, the petitioner has enclosed with his petition the copies of Guidelines issued by the CBSR for Centre Superintendents, which are to the following effect:- “4.5.11     

The doors of the exam/hall should be opened 45 minutes before the time specified for the commencement of Exam every day, i.e. 09.45 a.m. Candidates should be advised to be in their seats 30 minutes before the scheduled commencement of the examination i.e. by 10.00 a.m. After the commencement of the examination, no candidate is allowed inside examination centre.”

The petitioner has further alleged that two more students were also stopped from appearing in paper of English on that day, and when the parents of students approached  the DC, Bathinda, the latter  deputed DEO (Secondary) to resolve the dispute, and on asking by the latter, the Deputy DEO (Primary), Bathinda, reached the School, who could not resolve the matter.

Then Tehsildar, was appointed by the DC as Duty Magistrate, but the Centre Supdt did not open the gate of Examination Hall for  him also. Duty Magistrate then called SHO, Police along with Police personnel, who got the gate of examination hall opened with the help of Police officials standing inside the Examination Hall, but by then the examination time was over. The DEO (Secondary), Bathinda procured the footage of CCTV Cameras installed at the gate of examination Hall.

The petitioner, in his writ petition, filed through his father and natural guardian, Hem Raj Bansal, has prayed for direction to CBSE for conducting special paper of English for the petitioner, or to pay to him compensation of Rs. Ten lakhs, for wastage of valuable one year of his educational career. He has also demanded that CBSE be directed to disaffiliate St Xavier Senior Secondary School, Phase-3, Modal Town, Bathinda,for the aforesaid conduct of its Principal.
