The court not only revoked the bail but also drew parallels between the controversial comments and the haunting memories of the 1984 Sikh Genocide, considering them on par with the darkest moments in Indian history.
The case, registered under sections 295-A, 298, 153-A, 506, and 34 of the IPC, stems from comments made by Rahul Sharma in a video regarding the murder of Hindu leader Sudhir Suri in December 2022. In the video, he used objectionable language against the Sikh community, leading to his arrest on May 5, 2023, by the Amritsar Sadar police.
Upon filing a second bail petition, the case reached the bench of Justice Jasgurpreet Singh Puri. Justice Puri, in his examination of the alleged video post, drew a connection between the petitioner's remarks and the 1984 Sikh Genocide. He expressed that the purpose of such inflammatory statements on social media appeared to incite communal unrest, akin to the tragic events that transpired during the dark chapter of the Sikh Genocide.
Justice Puri emphasized that the state had effectively curtailed any potential escalation of tensions resulting from such provocative statements. The court's decision to cancel bail underscores the gravity of the situation and the need to prevent any form of speech that may contribute to the disharmony within communities.
