Arvind Kejriwal Latest News Today: In a major development, the Supreme Court on Friday granted interim bail to Delhi Chief Minister Arvind Kejriwal in the case filed by the Enforcement Directorate over the liquor policy case. According to information, the Supreme Court has referred Arvind Kejriwal's petition challenging the ED arrest to a larger bench.
It is pertinent to mention that even though Arvind Kejriwal has been granted interim bail, he will still stay in Tihar Jail because the Central Bureau of Investigation (CBI) had also detained him in a case related to corruption, involving the purported liquor policy case.
While granting interim bail to Arvind Kejriwal in the ED case, the Supreme Court left the decision to him to take a call on stepping down as Delhi CM.
"We are conscious that Arvind Kejriwal is an elected leader and the Chief Minister of Delhi, a post holding importance and influence. While we do not give any directions as we are doubtful whether a Court can direct an elected leader to step down or not to function as a Chief Minister or a Minister, we leave it to Arvind Kejriwal to make a call."
Justice J Khanna also said, "Power of court is different from power of officer...we have referred to reasons to believe...on S.19, we have held that as far as reasons to believe, they meet with parameters of S.19. We have raised the additional ground of need, the necessity of arrest."
"Especially because of the doctrine of proportionality...that we have referred to a larger bench. So what is the policy of arrest and the basis we have referred? We have framed 3 questions," he said, adding "Whether need, the necessity of arrest refers to the satisfaction of formal parameters of arrest...We have held mere interrogation does not allow to arrest."
